We use the personal information you share with us to make both our products and services, as well as your experience, continually better. This privacy policy aims to give you a clear view of how we use the personal information you provide, our efforts to protect it, your rights, and the options you have to control your personal information and safeguard your privacy. It also describes what kind of personal information we collect about you when you visit our website, stores, or use our mobile applications, how we use your personal information, and the third parties we will share it with.

MasTrainer will collect, use, process, store, circulate, transmit, and transfer your personal data in accordance with the guidelines set out in this privacy policy.

“Personal information” is any information related to you that personally identifies you, either separately or in combination with other information available to us. MasTrainer will collect various types of personal information and special categories of personal data (such as health data and other confidential information) about you, including but not limited to the following (as applicable):

V. UNIQUE GLOBAL REGISTRATION FOR MASTRAINER

Registration for a MasTrainer account, which will allow you to use the same login information anywhere in the world, is done through Google or Apple ID, Google only for Android, and Google or Apple ID for iOS. This will grant access to your name, email address, and date of birth.

VI. YOUR MASTRAINER ACCOUNT

MasTrainer may also collect the following information when you register for an account, if you choose to provide it: gender, personal preferences, social identifier (if you choose to access your account through a social network), and age or date of birth.

VII. USE OF OUR PRODUCTS AND SERVICES

When you use our products and services, we will ask for personal information (at the time of data collection, we will explain what information is required and what information you can choose to provide), such as:

  • Postal address and payment details when placing an order in our online store.
  • Date of birth and/or confirmation that you are over a certain age.
  • Your email address when registering for one of our contests, free prize draws (“Prize Draws”) or newsletters.
  • A record of correspondence with you (including any information you have provided in any of our products or services) if you have been in contact with our Customer Service.

MASTRAINER APP: Our app allows you to upload and/or save certain information. We will ask for personal information (we will explain what information is necessary to provide the service and what information you can choose to provide so that we can understand your preferences), such as:

  • Sport and health data (for example, start and end times of training, type of activity, duration, pace, distance, calories, and speed);
  • Body measurements, such as weight, height, and heart rate;
  • Location – georeferencing data.

MASTRAINER COMMUNITIES: If you become a member of a MasTrainer community (“Member”), we will ask for basic personal information (we will explain what information is needed and what information you can choose to provide), such as: your name, email address, and date of birth. Once you are a member, you may choose to provide us with additional personal information, such as: 

  • your interests and preferences. 

If you are a winner of any of the prize draws, we will ask for additional personal information, such as: 

  • your postal address and shoe or clothing size, in order to send the prize.

If we want to promote the MasTrainer Communities and prize draws and you are a winner of a draw, we will ask for additional personal information, such as: 

  • City, 
  • Your photo.

REGISTRATION THROUGH A SOCIAL NETWORK: If you decide to create a MasTrainer account through your social network account (such as Facebook), your login credentials will be imported through your social network account. Please note that when you use this “social login” option, we will use the following personal data: 

  • Your Facebook ID. 

We will often also receive certain personal information (which you have agreed to have accessible on your public profile) through the social network, such as: 

Your name, age, location, preferences, occupation, and other information from the public profile, such as your photos, your list of friends on the social network, or your likes. The social network will not share this information with MasTrainer if you have a private profile.

MasTrainer does not request this information, but it is provided by the social network through the use of the social login option if you have a public profile, in accordance with the terms of use of the social network. MasTrainer will not use this information without your consent.

VIII. INFORMATION WE COLLECT AUTOMATICALLY

We will also collect personal information about you when you interact with our brands, websites, and applications, and how you use them, in the following ways:

  • Websites: We will collect information about the MasTrainer websites you visit and how you use them. When you visit one of our websites, data from your browser will be sent to our servers. This way, we will collect personal information such as: 
  • Your IP address. 
  • The date and time of the visit and how long you stayed on our website. 
  • The referral URL (the site from which the visitor arrived). 
  • The pages visited on our website. 
  • Information about the device and browser (such as browser type and version, operating system, etc.).
  • Cookies and similar devices: We and our partners use various technologies to collect and store information when you visit our websites or use our applications, and this will include sending one or more cookies or similar devices to the device. IX. SOURCES OF INFORMATION

Most of the information we collect about you will be personal information that you have voluntarily provided to us, for example, through our websites, online stores, mobile applications, etc.

Additionally, we access information provided by the “Valkyria” application, owned by the company Ivolution. This information, when received by us, undergoes the same treatment as any other information collected by MasTrainer, meaning it is handled with the confidentiality and care mentioned in this privacy policy.

MasTrainer is solely responsible for the handling of its own information and privacy, and not for any actions that the aforementioned “Valkyria” application may take with its database or the information it receives.

X. CASES WHERE PRIOR AUTHORIZATION IS NOT REQUIRED

In certain specific cases, MasTrainer will not be obligated to request prior, express, and informed authorization from the data subjects to process their personal data, including sensitive data. Some of these events are as follows:

  • Processing of public information.
  • In cases of medical or health emergencies.
  • Any other exceptions contemplated in Law 25.326 and any rule that modifies, adds, or replaces it.

XI. HOW WE USE YOUR PERSONAL INFORMATION

The personal information we collect when you first register will be used for identification and authentication across all MasTrainer services, allowing you to use the same account details to log in from anywhere and any device. The global single sign-on enables MasTrainer systems to identify you anywhere in the world, eliminating the need to register with us again if you log in from another country.

Furthermore, MasTrainer creates a profile for you with the necessary information to provide you with our products and services. The personal information we obtain from the aforementioned sources will be used in the format received or may be combined with personal information obtained from other internal or external sources, as applicable. We use and analyze this personal information for the following purposes:

  • Improvement of our products and services: We use your personal information to create a profile about you in order to understand how you use our products and services, to develop more interesting and relevant products and services, and to personalize the products and services we offer you.
  • Order processing: We use the relevant personal information described above (including your name, address, and payment details) to process and deliver your order and to inform you of the status of your order. Additionally, we may use your age, birth year, or confirmation that you exceed a certain age to determine if you meet the minimum age requirements in your country for online purchases and if you are considered a minor for data protection and/or marketing laws.
  • Conducting checks: We will also use your personal information to assess your creditworthiness and prevent fraud. To this end, we may need to share your personal information with our credit rating providers (see “How We Share Your Personal Information” below).
  • Customer service: If you contact our Customer Service (or vice versa), we will use personal information such as your order information and contact history to process your request and provide you with the best possible service.
  • MasTrainer Products, Commitments, and Offers: We will use your personal information to offer you the products and services you have requested from us, such as promotions, affiliation to MasTrainer communities, MasTrainer loyalty programs, events, and our applications. This may include using your personal information for your participation in contests, prize draws, and promotions, using your contact details for events, and using information such as your location for our applications.
  • MasTrainer Applications: If you decide to download a MasTrainer application, we will only collect special categories of personal information if we have obtained your explicit consent, as required by applicable law. 

The personal, confidential, or sensitive information (e.g., health data) collected through the application will be taken from the device and stored on MasTrainer servers for the following purposes:

  • To provide the services you expect when using the application.
  • For the reasons outlined in the section “Improvement of our products and services” below.
  • For the reasons outlined in the section “Marketing Purposes” below.
  • Notwithstanding the above, there will always be the option not to provide sensitive information.
  • MasTrainer Communities: As part of a MasTrainer promotion, we may publish certain data of prize draw winners on our website or on one of our affiliates’ or service providers’ websites in accordance with the terms and conditions of that particular promotion.

Social Login (meaning the use of your social media credentials such as your login information as a Facebook user to create your MasTrainer account and log in to it): when you use the social login option, MasTrainer will limit the use of public profile information to what is necessary for creating your MasTrainer account. MasTrainer will discard any irrelevant information it receives from the social network. After creating your account, you will have the opportunity to supplement it with any information you wish to share with us, such as personal information you provide when completing a survey. Any additional information you provide to us will be used for the purposes outlined in this policy, including enriching your MasTrainer profile and personalizing the MasTrainer experience.

Marketing: When you sign up to receive MasTrainer newsletters, create a unique MasTrainer account, become a member of a MasTrainer community, use a MasTrainer application, purchase or provide information about a product or service online, or use our website, we will use your personal information to create a profile based on the information we have about you. We create your profile according to your preferences in order to provide you with the best personalized experience, send you personalized marketing messages and newsletters, and for opinion studies.

Below, you can find a more detailed description of how we will use your personal information for these purposes:

Type of Information: Your interactions with our brand through the various channels described above (e.g., MasTrainer website, applications, WhatsApp, social media, and marketing messages we send you) and the information we collect from each of these channels provide valuable insights into your interests and preferences. These insights give us the opportunity to offer you the best MasTrainer experience possible. To learn about you and your interests, we analyze your interactions with our brand through various types of information, as indicated. Specifically, we may combine the information we collect with information collected by third parties. If you have given us your consent to send you marketing communications, we will use the information you provide when interacting with us to send you personalized marketing messages about MasTrainer products or services, events, prize draws, and promotions. In some cases, we may also combine your personal information with that of others to create detailed reports on how customers use our products and services, and their experience with our brand.

Type of Channels: We will send direct marketing communications through the channel you choose, such as email, phone, or social media. We will request your consent, where required by applicable law, to use the contact details you have provided us to send our personalized marketing communications.

Type of Messages: The messages we send you will be personalized and tailored to your individual preferences and interests. We use analytics to generate this type of personalized messaging. These direct marketing messages may contain information about our products and services, events, prize draws or promotions, and MasTrainer news. Under certain circumstances, we will also use the channels to request your opinion (such as asking if you would like to participate in a survey) and to learn about your experience with MasTrainer and improve it, including sending personalized messages.

Advertisements: We also work with non-MasTrainer companies that use tracking technologies to deliver ads on our behalf on the Internet. These companies may collect personal information about your visits to our websites or applications and your interaction with our communications, including advertising.

Data Enrichment: When we have obtained your personal information from various sources, we may, in certain circumstances, combine it to enrich our understanding of your needs and preferences in relation to our MasTrainer products and services. For example, we may combine the information you have provided us directly with information collected automatically (such as IP addresses or metadata). When we have collected anonymous browsing data through the use of cookies, we may later determine that this information is related to your browsing history and combine that data with existing information we have about you. We may also combine this information with other information (both personal and anonymous) that we obtain from third parties. Improvement of Our Products and Services: We will use the personal information we have about you (as well as anonymous or semi-anonymous information generated from your personal information) to conduct analysis and research, including:

– Data Science/Analytics, where we combine information (for example, personal information and/or confidential personal information obtained through the use of a MasTrainer sports app or your browsing history) that we maintain on a large scale in order to:

  • Better understand our customers and their preferences.
  • Identify patterns and trends among our customers.
  • Enhance the user experience on our websites.
  • Provide information, content, and offers tailored to our customers’ needs.
  • General research and statistical purposes.
  • Generate joint reports within the MasTrainer group.
  • Develop new products and services.
  • Monitor the performance of our products and services and/or improve our technology.
  • Send you personalized marketing messages.
  • Display ads on the Internet.

– Website: Personal information collected through our websites, such as through cookies or other tracking technologies, will be used to allow us to evaluate browsing habits on our websites, identify areas for improvement, optimize our products and services, and personalize and enhance your experience on our websites and applications.

– Performance Analysis: We will use your personal information (including through anonymization and combining it with personal information from other customers) for financial, sales, and supply chain analytical purposes to determine if MasTrainer is performing well and where improvements can be made, and, when necessary, to report to our parent or affiliated companies.

We will seek your consent if we intend to use your personal information for purposes other than those mentioned in this privacy policy, and if required, in accordance with applicable legislation.

XII. HOW WE SHARE YOUR PERSONAL INFORMATION

We handle your personal information with care and confidentiality, and we do not share it with third parties unless specified below:

WITH OTHER ENTITIES OF THE MASTRAINER GROUP: We share limited personal information that you provide when registering (such as name, email address, password, and date of birth) with other entities of the MasTrainer Group to enable global single sign-on and for authentication purposes. This allows you to use the same login information anywhere in the world, and our systems will recognize your data.

We may share the information stored in your profile with other entities of the MasTrainer Group if both entities are responsible for your personal information, or if the other entities act as service providers and process your personal information according to our instructions or on our behalf.

WITH SERVICE PROVIDERS: We share limited personal information provided by you during your unique MasTrainer registration (your name, email address, password and date of birth) with our cloud service providers for identification and authentication purposes. This allows you to log into your MasTrainer account quickly and easily from anywhere in the world.

We will also share your personal information, only when necessary and for the purposes described above, with various third parties who will process your personal information on our behalf. This may include third parties managing contests/prize draws, hosting providers, delivery or courier services, payment and fraud management, as well as credit rating agencies and analytic platform providers, among others. We require these service providers and other third parties to comply with strict rules when processing your personal information, including using your personal information only in accordance with MasTrainer’s instructions and applicable laws.

WITH SOCIAL MEDIA: Our website and applications may, under certain circumstances, provide you with social media plugins from various social networks. If you choose to interact with a social network, such as Facebook or Twitter (for example, by registering an account), your activity on our website or through our applications will also be available to that social network. If you are logged into one of these social networks during your visit to one of our websites or applications, or if you are interacting with one of the social media plugins, the social network may add this information to your respective profile on that network according to your privacy settings. If you wish to prevent this type of data transfer, log out of your social network account before entering one of our websites or applications, or change the privacy settings of the application, whenever possible. WITH MASTRAINER LAW ENFORCEMENT AND LEGAL AUTHORITIES: MasTrainer will disclose personal information when required by law or in a legal process, for the administration of justice, to protect your vital interests, for investigations conducted by law enforcement or regulatory bodies, to protect and defend the property and legal rights of MasTrainer, to protect the personal safety of users of the MasTrainer website or applications (mobile), or by order of a valid court order or law enforcement agency.

WITH YOUR CONSENT: We will share your personal information with other third parties (different from those described above, for example, sports centers or gyms, or when you decide to connect our devices with devices from other manufacturers) in other limited circumstances. In such instances, where required by applicable law, we will obtain your consent to share your personal information in this way.

XIII. HOW WE PROTECT YOUR PERSONAL INFORMATION

We are committed to protecting your personal information and implementing appropriate technical and organizational security measures to safeguard it against any unauthorized or unlawful processing and against any accidental loss, destruction, or damage.

XIV. RETENTION OF YOUR PERSONAL INFORMATION

We will retain your personal information for a period of two years from your last interaction with us, such as the date your account was deleted, your last purchase, the last time you used one of our applications, or any other form of contact or interaction, unless the law requires a longer or shorter retention period, is necessary in the course of a legal proceeding, or is required for a specific purpose according to applicable law.

The following are examples illustrating how MasTrainer retains your personal information for as long as necessary for a specific purpose:

  • We may keep your personal information collected during a purchase for as long as tax laws require.
  • We may keep your personal information for a shorter period if you request us to delete your personal information. In such case, MasTrainer aims to delete your personal information within a maximum period of one month from the date of the request.

XV. INTERNATIONAL TRANSFERS OF YOUR PERSONAL INFORMATION

Unless otherwise stated, we store and process your personal information in Argentina and the USA. However, there may be occasions when we need to transfer your personal information outside of Argentina, to a country that provides the same level of data protection as the country where you normally use our products or services.

As a general rule, we do not intentionally collect personal information from individuals under the age of 18. Please note that our mobile application may also send you messages, including (if you have given your consent) push messages, for example about new products or services. In this case, the relevant mobile application will provide you with notices just before we send the push notifications. You can disable these messages through the settings on your phone or in the application, or choose to uninstall the application to stop receiving the messages.

XXI. DELETION OF INFORMATION

You may request MasTrainer to delete your personal information at any time. We will review your request and, when necessary, fulfill it in accordance with applicable law, as explained above.
